These terms govern your use of StreamerVitals at streamervitals.com. They are written to be read: what you may do with the figures published here, what the figures are and are not, and where the limits of our responsibility sit.

By accessing streamervitals.com you agree to these terms. If you do not agree with them, please do not use the site. In these terms, “we”, “us” and “our” refer to StreamerVitals, the operator of StreamerVitals; “you” refers to anyone accessing the site, whether as a person or on behalf of an organisation.
These terms sit alongside the privacy policy, which forms part of them.
StreamerVitals is a free, independent analytics service. It observes public Twitch broadcasts through the official Twitch API and publishes statistics derived from those observations. There is no account to create, nothing to purchase, and no contract for the supply of a service beyond your ability to read publicly available pages.
The site is provided for information and research. It is not a professional advisory service, and nothing on it is financial, commercial, legal or investment advice.

We may restrict or block access, temporarily or permanently, where we reasonably believe these rules are being broken or the stability of the service is at risk.
Public endpoints — in particular site search and on-demand channel lookup — are rate limited per client. The limit in force is advertised on every response in the X-RateLimit-Limit header, with the remaining allowance in X-RateLimit-Remaining. A request over the limit receives HTTP 429 with a Retry-After header stating when to try again.
If you are writing anything automated that touches this site, honour those headers. Back off on 429 rather than retrying immediately, identify your client honestly in its user agent, and do not parallelise around the limit. Deliberately evading rate limits is a breach of these terms regardless of the volume involved.
There is no public data API and no bulk export. If you have a research or press use that ordinary browsing does not serve, write to [email protected] and describe it — a specific request is far more likely to get a useful answer than an undeclared crawler.
Every figure on this site is a sampled estimate, and the service is provided “as is” and “as available” without warranties of any kind, express or implied. To the maximum extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose, accuracy and non-infringement.
Concretely, and without limiting the above:
The methodology page documents all of this in detail, and reading it is the best way to understand what a given number will and will not support. Do not rely on figures from this site as the sole basis for a financial, contractual or commercial decision — including sponsorship valuations — without independent verification.
The measurements we take, the statistics and scores we derive from them, the selection and arrangement of that data, the charts, the page text, the design and the software behind the site are our intellectual property, and where applicable are protected as a compilation or database. Quoting individual figures with attribution is welcome; wholesale extraction of the compilation is not.
Channel names, display names, avatars, channel descriptions, broadcast titles, category names and box art are the property of Twitch Interactive, Inc. or of the respective creators. We display them under the Twitch Developer Services Agreement, refresh our cached copies within the permitted window, and remove them when Twitch reports the source as deleted. Images are always loaded directly from Twitch’s content delivery network — we do not mirror, re-host or re-encode them.
Twitch is a trademark of its respective owner. We use the word only to describe the platform we report on, and we do not use Twitch branding, logos or colours as our own identity.
Where you reuse a figure, cite it as coming from StreamerVitals and state the period it covers. “Average viewers over the last 30 days, per StreamerVitals” is accurate and useful. “Twitch says…” is neither.
If you are a streamer, your channel may appear here because it broadcast publicly and the Twitch API reported it. You can ask us to correct information or to remove cached channel material: the process, what we can remove, what we may retain as our own measurements, and the verification we require are all set out at data removal.
Rights holders with a copyright or trademark concern about material displayed here should write to [email protected] with enough detail to identify the material and the right asserted.
The service is free and provided without any guarantee of uptime, continuity or retention. We may change, suspend, restrict or discontinue any part of it — including individual pages, boards, metrics or the whole site — at any time and without notice. We may also change how a metric is calculated; when we do, the change is reflected on the methodology page, which is generated from the same values the system runs on.
The site links to twitch.tv and may load images from Twitch’s content delivery network. Those destinations are outside our control, have their own terms and privacy practices, and we are not responsible for their content or availability. The same applies to any advertising served on the site if and when advertising is enabled.
To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, business, goodwill, opportunity or data, arising out of or in connection with your use of, or inability to use, this site or its data — whether based in contract, tort, negligence, strict liability or otherwise, and whether or not we were advised of the possibility of such loss.
Because the service is provided free of charge, our total aggregate liability for all claims relating to the site is limited to the greater of the amount you have paid us for it (which is nothing) or, where a jurisdiction requires a monetary cap rather than an exclusion, one hundred United States dollars.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, for fraudulent misrepresentation, or for death or personal injury caused by negligence. Some jurisdictions do not allow the exclusion of implied warranties or the limitation of certain damages, so parts of this section may not apply to you; where that is the case, the remaining provisions stand and our liability is limited to the fullest extent the law allows.
You agree to indemnify and hold us harmless from any claim, demand, loss or expense (including reasonable legal fees) arising from your breach of these terms, your misuse of the site or its data, or your infringement of the rights of a third party in connection with material you took from this site.

These terms are governed by the laws of [JURISDICTION], without regard to its conflict-of-laws rules, and the courts of [VENUE] have exclusive jurisdiction over any dispute arising out of or relating to them.
This paragraph is deliberately unfinished. Governing law and venue depend on where the operating entity is actually established, and inserting a plausible-sounding jurisdiction would be worse than admitting the gap. The operator must replace the bracketed terms with the correct jurisdiction and venue — and should have the whole of this page reviewed by a qualified lawyer in that jurisdiction — before the site is presented as a commercial service. Consumer protection rules in your country of residence continue to apply regardless of what this clause eventually says.
We may revise these terms. The date at the top of this page records the last substantive revision, and continued use of the site after a revision means the revised terms apply. If a change is material — a new restriction on use, for example — we will say so rather than quietly editing a sentence.
If any provision of these terms is held unenforceable, it is severed and the remainder continues in force. Our failure to enforce a provision is not a waiver of it.
